Third-Party Services and links thereto are provided solely as a convenience to you and you access and use them entirely at your own risk and subject to such third parties' terms and conditions.

ABUSE

If LONGSHOT.AI finds that you're abusing the software or indulging in unethical practices, we reserves the right to cancel your subscription and/or ban you from further use of the tool. LONGSHOT.AI has no obligation to present a proof of abuse, whatsoever.

‍TERMS OF TERMINATION

This Agreement shall remain in effect until terminated by you or LONGSHOT.AI.
LONGSHOT.AI may, in its sole discretion, at any time and for any or no reason, suspend or terminate this Agreement with or without prior notice.
This Agreement will terminate immediately, without prior notice from LONGSHOT.AI, in the event that you fail to comply with any provision of this Agreement.
Termination of this Agreement will not limit any of LONGSHOT.AI's rights or remedies at law or in equity in case of breach by you (during the term of this Agreement) of any of your obligations under the present Agreement.

FAIR USAGE POLICY

As part of our commitment to providing a high-quality, fast and reliable service, LONGSHOT.AI has a Fair Use Policy (also referred to as the FUP) to prevent excessive use of our subscription plans.
We do not charge extra costs when the tool is used reasonably and normally. We do however need to ensure that the provision of our services works fairly for everyone and with the best possible user experience. This should always mean the quality of service to every user, in an even-handed and equitable way.
Therefore, the "Unlimited" credits allowance is subject to a fair use policy. If on any day of your monthly billing period, you exceed the fair usage amount, we may temporarily restrict or rate limit your access to the service for that day.

INDEMNIFICATION

You agree to indemnify and hold LONGSHOT.AI and its parents, subsidiaries, affiliates, officers, employees, agents, partners and licensors (if any) harmless from any claim or demand, including reasonable attorneys' fees, due to or arising out of your: (a) use of the website; (b) violation of this Agreement or any law or regulation; or (c) violation of any right of a third party.

NO WARRANTIES

The website is provided to you "AS IS" and "AS AVAILABLE" and with all faults and defects without warranty of any kind. To the maximum extent permitted by applicable law, in no event shall LONGSHOT.AI or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever (including, but not limited to, damages for loss of profits, for loss of data or other information, for business interruption, for personal injury, for loss of privacy arising out of or in any way related to the use of or inability to use the website, third-party software and/or third-party hardware used with the website, or otherwise in connection with any provision of this Agreement), even if LONGSHOT.AI or any supplier has been advised of the possibility of such damages and even if the remedy fails of its essential purpose.
Some states/jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you.

LIMITATION OF LIABILITY

If any provision of this Agreement is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.

WAIVER

Except as provided herein, the failure to exercise a right or to require performance of an obligation under this Agreement shall not effect a party's ability to exercise such right or require such performance at any time thereafter nor shall be the waiver of a breach constitute waiver of any subsequent breach.

AMENDMENTS TO THIS AGREEMENT

LONGSHOT.AI reserves the right, at its sole discretion, to modify or replace this Agreement at any time. If a revision is material we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use our website after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use LONGSHOT.AI.

ENTIRE AGREEMENT

The Agreement constitutes the entire agreement between you and LONGSHOT.AI regarding your use of the website and supersedes all prior and contemporaneous written or oral agreements between you and LONGSHOT.AI.
You may be subject to additional terms and conditions that apply when you use or purchase other LONGSHOT.AI's services, which LONGSHOT.AI will provide to you at the time of such use or purchase.

LONGSHOT.AI is not responsible for any content, code or any other imprecision.
LONGSHOT.AI does not provide warranties or guarantees.
In no event shall LONGSHOT.AI be liable for any special, direct, indirect, consequential, or incidental damages or any damages whatsoever, whether in an action of contract, negligence or other tort, arising out of or in connection with the use of the Service or the contents of the Service. The Company reserves the right to make additions, deletions, or modifications to the contents on the Service at any time without prior notice.

Cancellation & Refund Policy

‍If, for any reason, you are not completely satisfied with the service that we provide, you can cancel are your subscription. The subscription will still be available till the end of the subscription period.

The refund cannot be exercised retrospectively, i.e. you can not seek refund for the service already paid for for which refund period is either over or is not explicitly mentioned.

    In order to provide the App, We automatically track and collect the following categories of information when You use the App: 1. IP addresses; 1. Domain servers; and 1. Other information with respect to Your device, interaction of Your device with the App and applications (collectively "Traffic Data").

    In order to provide the App, We may require You to provide Us with certain information that personally identifies You ("Personal Information"). Our App may transmit your Personal Information to our internal servers.This Personal Information is immediately deleted once you delete the App, except to the extent it is necessary to store the same under applicable laws. Further, we have implemented commercially reasonable physical, managerial, operational and technical security measures to protect the loss, misuse and alteration and to preserve the security of the Personally Information in our care.Finally, this information is used strictly in line with our business purposes and to provide you with useful features.

You understand that once You leave Our servers, use of any information You provide shall be governed by the privacy policy of the operator of the site used by you.
  5. Our App may track users' submitted information (name, email, plan name) in the cart after they have abandoned the cart, and store it in our internal servers.

‍LIMITED USE DISCLOSURE

LongShot AI’s use and transfer of information received from Google APIs to any other app will adhere to Google API Services User Data Policy, including the Limited Use requirements.

LongShot AI is steadfast in its commitment to safeguarding the privacy of our users. Through the integration of Google APIs, we facilitate a seamless exchange of information between our users' Google Drive and our application. This integration enables users to effortlessly import content from their Google Drive into the LongShot AI app, as well as export content created within our app directly back to Google Docs. We collaborate with premier large language models (LLMs) including OpenAI, Claude, and Mistral, to process the content selected by our users for content generation purposes. It is important to note that these LLMs are engaged solely for the processing of our users' data and do not receive any user information beyond what is authorized by our users. The process for both importing and exporting user-selected data commences only with explicit consent from our users. Our utilization of Google user data is confined strictly to the described secure import and export functions, ensuring the integrity and privacy of our users' information.
